Employees managing anxiety, depression, PTSD, or other mental health conditions may be entitled to workplace protections under multiple federal laws. Here’s what employers need to keep in mind:

  • FMLA – Serious mental health conditions may qualify for job-protected leave under the Family and Medical Leave Act. This includes inpatient care or ongoing treatment by a healthcare provider.
  • ADA – The Americans with Disabilities Act may require employers to offer leave as a reasonable accommodation for qualifying mental health conditions—even if the employee is not eligible for FMLA.
  • PWFA – The Pregnant Workers Fairness Act may apply if a mental health condition arises or is exacerbated by pregnancy, requiring accommodations during or after pregnancy.
